The stepparent adoption process usually includes specific steps and processes. CA Law Docs, LDAs will help every step of the way.
The stepparent seeking to adopt must be legally married to the child's biological or adoptive parent. Certain stepparent adoptions will require consent from the child's other biological parent unless they have abandoned the child or their rights have been terminated. If the other parent does not consent, their rights may need to be terminated involuntarily by the court.
The stepparent files a petition for adoption with the court. This typically includes information about the stepparent, the child, the biological parents, and the reason for the adoption.
Upon acceptance of the petition for adoption, the court will require background checks for the stepparent, including fingerprinting and possibly a child abuse registry check. A social worker may conduct a home study to evaluate the suitability of the stepparent's home for the child.
Once the investigation is complete, a hearing will be scheduled where the judge will review the petition, background checks, and home study report. If everything is in order and in the best interests of the child, the judge may grant the adoption.
Once the adoption is granted, a finalization hearing will be scheduled. At this hearing, the judge issues a final decree of adoption, legally establishing the stepparent as the child's parent.
After the adoption hearing we will process the request for an amended birth certificate for the child, reflecting the stepparent as the child's legal parent.
It's important to note that each case is unique, and the process may vary depending on factors such as the age of the child, the relationship with the non-custodial parent, and any contested issues.
